FIELD SOBRIETY TESTS

Field Sobriety Tests (FST) are tests conducted by the police officer who pulls you over in order to determine if you are mentally and physically capable of safely driving and operating a motor vehicle. These tests are given to monitor your balance, coordination and motor skills. These tests are supposed to determine inebriation, but are almost impossible to pass, even when sober for some. Also, these tests are not mandatory and can be declined. You can simply ask to take a blood test instead.

The National Highway Safety and Traffic Administration (NHSTA) only has three field sobriety tests that are considered standardized: the horizontal gaze nystagmus, the walk and turn, and the one leg stand. There are a number of reasons in which a person can perform poorly on these tests including, road conditions, poor lighting or unclear instructions from the officer. Our Santa Barbara DUI Defense firm will understand how to use these defenses if you have failed the field sobriety tests.
