Driving on Suspended License

Driving on a suspended license following an arrest for a Santa Barbara DUI is a serious offense and can result in mandatory jail time.  After an arrest for a Santa Barbara drunk driving incident a California Licensed driver will have their license confiscated and replaced with a temporary license which grants full driving privileges for 30 days.  If you contact the DMV within ten days of your Santa Barbara DUI you can request a hearing and a stay on the automatic suspension following the arrest.  Failure to contact the DMV timely after an arrest for a Santa Barbara DUI will result in a four month suspension of your license after the expiration of the temporary license issued to you following your arrest.  If you timely request a hearing from the DMV following a Santa Barbara DUI arrest a hearing will be held to determine the validity of the arrest, probable cause for the stop and BAC level at the time of driving.  If you lose the hearing the stay on your license will be ended and the suspension will be reinstated.
